Late last month, the Federal Acquisition Regulation Council proposed an unusual rule, one that specifically stated that agencies are encouraged to engage in “responsible and constructive exchanges with industry, so long as those exchanges are consistent with existing laws and regulations, and promote a fair competitive environment.” In other words, the rule isn’t a rule at all, but a pat on the back and a nudge in the right direction.

But it’s a welcome nudge. As several experts noted recently, despite a number of initiatives to encourage communication, there’s still a wall up between agencies and contractors.
